The present General Conditions of Use and Online Sale are intended to disclose and determine all the fundamental information to the user about the modalities of ordering, sale, payment and delivery of purchases made in the Jomafe.pt domain, owned by José Maria Ferreira S.A., a company registered in Portugal. Before making an online purchase, you must agree and be aware of these General Conditions of Use and Online Sale, in order to proceed safely and correctly with the purchase. 

By validating an order, the user is accepting these General Conditions of Use and Online Sale, as a private individual, who has full and complete legal capacity to contract and place an order online, namely in the store jomafe.pt. 

The following General Conditions of Use and Online Sale apply to the sale of articles through the jomafe.pt domain, guaranteeing the delivery of orders in national territory (mainland). 

For online purchases, prior registration at the jomafe.pt domain is essential, in order to guarantee the veracity of the data provided as well as their use in the registration, invoicing, shipping and delivery process of the orders placed. 

JOMAFE (José Maria Ferreira S.A., NIF 504355473) reserves, however, the right to cancel the access account of a user/consumer, if fraudulent acts, data and/or information are detected in the respective use of this service. 

Product Catalog 

Availability of articles and stock management 

The fulfilment of orders placed on the jomafe.pt domain is subject to product stock availability. 

If the user/customer has placed an order for an article, which has been sold out, JOMAFE will inform him by email of this fact and will refund the amounts paid, within a maximum period of 30 (thirty) days, counting from the date of knowledge of the unavailability. 

Prices 

The price of each item may vary depending on ongoing campaigns. 

Thus, the price for each item is the one indicated in the jomafe.pt domain and applicable to the date of placing the order. 

Each price assigned already includes the I.V.A. (Value Added Tax), i.e. it is displayed in P.V.P. (Price for Public Sale). 

The reduced prices shown on the jomafe.pt domain are exclusive to the online store and may not be applicable in our physical sales locations. 

At any time and without prior notice, JOMAFE (José Maria Ferreira S.A., NIF 504355473) reserves the right to make any changes it deems necessary, being able to update, even daily, the articles and prices according to the latest news and campaigns that appear or even withdraw the articles before the end of the campaign. 

However, with each order placed and registered in the jomafe.pt online purchase system, the values ​​of the articles, shipping and other business elements will remain unaltered by the online sales contract at the date and time of closing the order. 

Balances, Promotions, Reductions and Liquidations 

JOMAFE (José Maria Ferreira S.A., NIF 504355473) reserves the right to carry out sales, promotions, price reductions, liquidations, flash-sales and issuance of discount vouchers at any time of the year, namely during festive seasons, special relevance for the family and/or days and seasons of tradition of exceptional discounts (such as Black Friday). 

Product warranty 

The warranty is valid for a period of 2 (two) years from the delivery of the item, upon presentation of proof of purchase on the Jomafe web site. 

All items that have been improperly and/or incorrectly handled and/or used by the customer are excluded from the scope of the warranty. 

To exercise their rights, the user/customer must report the lack of conformity to the seller within a period of 3 (three) days from the date on which the defect was detected. 

In order to activate the guarantee, the user/customer must contact the Customer Support Service using the form on our Contacts page. 

Orders, Order Form and Cancellations 

Order fulfilment 

All articles that appear in the domain jomafe.pt are only available for sale in Portugal (mainland). 

To place an order on the jomafe.pt domain, the user/customer must have an email account and adopt the following procedure: 

Register at the jomafe.pt domain, creating your personal account, being possible, at any time, to access and update your personal data and monitor the status of orders or returns. It is necessary to enter, in the personal profile, through login, to proceed with the ordering act; 

Select the items you want to buy and add them to the shopping cart; 

Fill in all the mandatory fields and choose the desired payment and transport method; 

Accept General Sales Conditions Policy; 

At the end of the order, a screen will be available with the confirmation and details of the order. In addition, you will also receive an automatic email message containing the order information. 

By submitting your order, the user/customer agrees with the General Terms and Conditions of Use and Online Sale, as well as with the Privacy and Personal Data Protection Policies (Legal Notices) contained therein. 

Order cancellation by JOMAFE (José Maria Ferreira S.A., NIF 504355473) 

JOMAFE (José Maria Ferreira S.A., NIF 504355473) reserves the right not to process orders without actually paying for them, or if they are incomplete or incorrect, or even if the article is no longer available, the same applies. in case of suspected fraud. 

The user/customer will be informed via email of the cancellation and, if applicable, refunded the amounts paid within a maximum period of 30 (thirty) days from the date of knowledge of the unavailability of the good and/or knowledge of the fact. 

JOMAFE (José Maria Ferreira S.A., NIF 504355473) also reserves the right to cancel any order, even if successfully completed, and is exempt from liability for any damages and/or costs, in the event of any of the following situations: 

Item unavailable (the amount paid by the user will be refunded using the same payment method used in the order); 

Incorrect billing information; 

Payment for the order not received (up to 3 working days after ordering); 

Delivery of order not achieved at the address indicated for shipping; 

Item price error. 

Promotion codes erros

Cancellation of the Order by the User 

The user/customer may cancel their order, provided that it has not yet been shipped, and should contact JOMAFE using the form on the Contacts page, indicating the reason for cancellation and attaching the order confirmation email. 

Payment methods 

During the purchase process, the user can choose the payment method that is most convenient for him, and the value of his order will not be modified by choosing the payment method. 

Online purchases at the jomafe.pt domain can assume the following payment methods: 

ATM 

Payments by Multibanco can be made through the ATM Network or through your Home banking. 

At the end of your order, an ATM reference will be generated. 

The user/customer will receive this reference in the order confirmation email. 

To pay at an ATM, the customer must select the option “Payment for Services/Purchases”, insert the corresponding entity, reference and amount. 

Items are reserved for 3 (three) days and if payment is not received for the order during this period, the order will be cancelled. 

MB Way 

When selecting this payment method, you are automatically forwarded to a secure page, where you must enter the mobile number associated with the MB Way. 

Payment by MB Way is made in the application, using an access code that allows the authorization and validation of the payment. 

It is a safe method and used all over the world. 

Credit or Debit Card 

You can pay by credit or debit card, VISA or Mastercard. 

Procedure:

Within seconds, you will have confirmation that the payment has been accepted.

Note that if you pay for an order with a card, the amount will be captive on the card but will only be charged when it is confirmed that there is stock. If there is a stock break, the amount will not be charged. 

We do not charge additional fees regardless of the payment method chosen. 

Whenever you pay for an order, you will be paying the value of the ordered products and shipping costs, which may or may not be free, depending on the method you have chosen. 

Payment methods providers and/or issuers may adopt anti-fraud measures that lead to the rejection of certain types of operations, an action to which JOMAFE (José Maria Ferreira S.A., NIF 504355473) is unrelated to the extent that it is a matter of security policies of financial partners. 

Delivery Methods 

The user/customer may choose the following delivery methods: 

home delivery 

All deliveries are made by DPD to mainland Portugal. 

At mainland delivery timeline to destinations may vary between 2 (two) to 6 (six) business days after receipt of payment for the order. 

The estimated average period starts counting from the moment the order is paid and the customer is notified by email. 

Given the pandemic situation we are going through, these deadlines can be extended, for reasons beyond JOMAFE (José Maria Ferreira S.A., NIF 504355473). 

In the ordering process, the billing address and delivery address must be indicated, without it being mandatory that they are the same, the data presented being the sole responsibility of the user. 

Exchanges and Returns 

Right of Free Resolution 

The user/customer has a reflection period of 14 (fourteen) days, counting from the date of receipt of the good/article, during which time he/she may return the article, in case of dissatisfaction, without having to indicate the reason. However, you must comply with the following assumptions: 

The article must not have been used or tampered with; 

Maintenance of the original characteristics of the article, accompanied by the undamaged packaging and labels; 

The article must be complete and properly packed in the original packaging (if the article consists of more than one piece, they must be returned in full); 

Inclusion of a copy of the printed invoice and express mention of the will to use the Right of Free Resolution. 

In order to exercise their right of free termination, the user/customer must inform us of their decision to terminate the contract by means of an unequivocal statement which must contain their name, geographic address and contacts, identification of the item purchased, date of request and receipt of the article, by means of a letter sent by post or email address already provided. 

The user/customer must, without undue delay and at the latest, within 14 (fourteen) days from the date on which he communicated his decision of free resolution, return or deliver the ordered article to the address of JOMAFE, attaching copy of the communication of resolution and the purchase invoice, through the following address:

The costs of this type of returns will be borne by the user/customer. 

JOMAFE (José Maria Ferreira S.A., NIF 504355473) is not responsible for any damage caused during the transport process. 

In the event of termination of this contract, the user/customer will be reimbursed for the payment made, including delivery costs (with the exception of additional costs resulting from your choice of a shipping method other than the less expensive method of normal shipping offered by us) , without undue delay and, in any case, no later than 14 (fourteen) days from the date on which we are informed of your decision of free resolution and provided that the article has already been delivered and received in the proper conditions, or until proof of submission of the article is provided, whichever occurs first. 

As soon as we receive the return, the user/customer will be informed by email of the receipt of the return and the refund of the amounts paid. 

We make refunds using the same payment method you used for the initial transaction, unless expressly agreed otherwise; in any case, the use does not incur any costs as a result of such reimbursement. 

Return for Nonconformity 

In the event of non-compliance of the article with the contract, the user/customer is entitled to have it replaced free of charge, by means of repair or replacement, to an appropriate reduction in the price or to the termination of the contract, unless otherwise stated. impossible or constitute an abuse of rights. For all stages of access to the jomafe.pt online page, the ordering process, delivery, Customer Support service or subsequent services, JOMAFE only supports the obligation of the medium. 

As a result, JOMAFE cannot be held liable for all inconveniences or damages inherent to the use of the Internet network, namely a service disruption, an external intrusion or the presence of computer viruses or any event qualified as force majeure, in accordance with applicable legislation. 

In addition, JOMAFE shall not be held responsible in the event that the order is not delivered or if it is prevented from complying with any of its obligations in a case of force majeure and, in particular, in case of bad weather and/or catastrophe that prevent the forwarding of the order.
